Privacy Policy

This Privacy Policy explains how Unfairly, Inc. ("Unfairly") collects, uses, and discloses information in connection with its website and the Unfairly platform (the "Service"). It distinguishes between two categories of data. Unfairly acts as a controller of information about its users, such as account and billing information. Unfairly acts as a processor of the content that a customer and its authorized users submit to their vaults ("Customer Data"), which the customer's organization controls and which Unfairly handles only to provide the Service under its agreement with that organization. Unfairly does not sell Customer Data and does not use it to train artificial-intelligence models.

1. Information we collect

1.1 Account information. When a user creates an account or authenticates, including through Google sign-in, Unfairly collects the user's name, email address, and, where applicable, company name and role.

1.2 Billing information. Payments are processed by Stripe. Unfairly receives limited billing details, such as plan, amount, billing contact, and the last four digits of the payment card. Unfairly does not store full payment-card numbers.

1.3 Customer Data. Unfairly receives the content that a customer and its authorized users submit to their vaults, and handles it as described above.

1.4 Usage and device information. Unfairly collects log data, IP address, browser and device type, product-analytics events through PostHog, and error diagnostics through Sentry.

1.5 Communications. Unfairly collects the content of messages that users send to it, such as support requests.

1.6 Cookies. The website uses only essential and analytics cookies (PostHog). It does not use advertising cookies or third-party advertising trackers.

2. How we use information

Unfairly uses the information it collects to provide, operate, secure, and improve the Service; to authenticate users and administer accounts and subscriptions; to process payments; to respond to support requests and send communications about the Service; to understand usage and diagnose errors; and to comply with legal obligations and enforce its agreements. For users in the European Economic Area and the United Kingdom, Unfairly relies on the legal bases of performance of a contract, its legitimate interests in operating and improving the Service, consent where required, and compliance with legal obligations. Unfairly does not sell personal information and does not share user email addresses with third parties for their marketing.

3. Artificial-intelligence processing

To provide the Service, Unfairly processes content using third-party artificial-intelligence providers. Unfairly generates vector embeddings of Customer Data for semantic search using OpenAI (text-embedding-3-small). Unfairly generates in-product features such as summaries, digests, and assistant responses using Anthropic and, as a fallback, Google. These providers are contractually restricted from training their models on Customer Data. Where a customer connects its own artificial-intelligence agent or tools to a vault through the Model Context Protocol, that agent operates under the customer's control and its provider's terms.

Unfairly will post material changes to this list and provide notice where required by its agreements.

5. Disclosure of information

Unfairly does not sell personal information. It discloses information only to the service providers listed above to operate the Service; when required by law or to protect the rights, safety, and security of Unfairly, its users, or the public; in connection with a merger, acquisition, or sale of assets, with notice; and with the user's consent or at the user's direction.

6. Data retention

Unfairly retains account and usage information for as long as an account is active and as needed for legitimate business and legal purposes. Customer Data is retained in accordance with the customer organization's subscription. Following termination, Unfairly makes Customer Data available for export for thirty days and then deletes it in the ordinary course. A user may request deletion of their personal information by contacting privacy@unfairly.ai.

7. Security

Unfairly maintains administrative, technical, and organizational safeguards designed to protect information, including encryption of data in transit and access controls. No method of transmission or storage is completely secure. Unfairly will notify affected users of a material security incident as required by applicable law.

8. Your rights

8.1 European Economic Area and United Kingdom. Individuals in these regions have the rights to access, rectify, erase, restrict, and object to the processing of their personal data, and to data portability, subject to applicable law.

8.2 California. California residents have the rights to know, delete, and correct their personal information, and to opt out of its sale or sharing. Unfairly does not sell or share personal information as those terms are defined under California law, and it will not discriminate against a resident for exercising these rights.

8.2.1 California disclosures. In the preceding twelve months, Unfairly has collected the following categories of personal information: identifiers (such as name, email address, and account and company details); commercial information (such as subscription and billing records); internet or other electronic network activity (such as usage and device data); and the contents of communications a user sends to Unfairly. Unfairly collects this information from the user, the user's device, and the user's organization, and uses it for the business purposes described in Section 2. It discloses these categories to the service providers listed in Section 4. Unfairly does not use or disclose sensitive personal information for purposes that require an opt-out right, does not sell or share personal information, and retains personal information as described in Section 6. A California resident may appeal a denied request by replying to Unfairly's response.

8.3 Exercising rights. To exercise any right, contact privacy@unfairly.ai. Unfairly responds within the periods required by applicable law.

9. International data

Unfairly operates in the United States and processes and stores information there. A user who accesses the Service from outside the United States consents to the transfer of information to the United States, and Unfairly relies on appropriate safeguards where required by applicable law.

10. Children

The Service is intended for business use and is not directed to children under sixteen. Unfairly does not knowingly collect personal information from children.

11. Changes to this policy

Unfairly may update this Privacy Policy from time to time. It will post the updated version with a revised date and, for material changes, provide reasonable notice.
